Sibal held a press conference to say that the government rejected all allegations against Chidambaram, Finance Minister at the time of spectrum allocation, and alleged that elements in the NDA were trying to malign and defame him.

He also said the then Telecom Minister A Raja did not hold any meeting with Chidambaram prior to the issuance of the Letter of Intent (LoI) to telecom operators (2G spectrum allocation) on January 10, 2008.

“In fact, the record will show that the Ministry of Finance had no no knowledge that the LoIs would be issued on January 10, 2008,” Sibal said.

He said Chidambaram as Finance Minister was in no way responsible for issue of Letter of Intent by Telecom Ministry then headed by A Raja in January 2008.

He said no official of the Finance Ministry, including the then Finance Minister, had committed any “irregularity or misconduct” in the spectrum allocation.

“People in NDA are trying to malign and defame P Chidambaram.  We reject all allegations against him in the 2G scam. Chidambaram is a valued colleague. He discharged his duties without any fear or favour,” the Minister said.

Sibal’s remarks come in the context of the opposition stalling Parliament demanding Chidambaram’s resignation following a Delhi court allowing  a petitioner to depose himself as a witness in a complaint seeking to file a case against the Home Minister.

“Therefore, any attempt by the opposition to foist any culpability on P Chidambaram  is not only irresponsible but is yet another desperate attempt to make the institution of Parliamentary democracy dysfunctional,” he said.

Sibal said as Finance Minister, it was Chidambaram who raised the issue of revision of entry fee, but it was the Telecom Ministry which was of the view that it would adopt the same policy that had been followed since 2003.

This included charging the same entry fee of about Rs 1,650 crore, he said.

“It is therefore preposterous to suggest that Shri P Chidambaram has any role to play in ‘fixing’ the entry fee for the LoIs issued on January 10, 2008,” he said.

When asked about Finance Ministry documents that purportedly showed Chidambaram and Raja meeting on fixing 2G prices, Sibal said there were meetings after the LoIs were issued in January but not before that.

Sibal also defended the policy on 2G spectrum allocation and pointed out that even the courts have not made out any charge of loss of revenue.

“The policy was right but the matter in courts is whether the policy was implemented properly or not,” he said.

In a four-page statement, Sibal listed out in detail the policies related to the opening up of the Telecom sector since 1994.

On acceptance of a petition in a Delhi court in connection with the 2G case, Sibal said the magistrate concerned was only following the law.

Sibal said it was wrong for a section of the media to paint this as a victory for the petitioner.

The law states that if a complainant goes to court with a complaint, under Section 200 of the code of criminal procedure his statement has to be recorded exparte by the magistrate, he said.

The complainant can also bring along witnesses whose statements shall also be recorded by the magistrate.

“Once that is done, the magistrate decides whether to order an inquiry or drop the procedure,” Sibal said.

On the 2G allocations, he said the Department of Telecom (DoT) maintained that dual technology licences were issued based on TRAI recommendations which had not suggested any changes in the entry fee.

“On August 28, 2007, TRAI recommended that there should be no change in the policy in allotting 2G spectrum on the ground that there should be a level playing field for new entrants,” Sibal said.

“DoT strongly relied on the said recommendation and reiterated the policy of no auction; no cap on number of licences; first-come-first-served basis; same entry fee; and licence bundled with spectrum,” he said.

Sibal also said that it is pertinent to point out that CBI has submitted to the Supreme Court that it had looked into the matter thoroughly, recorded the statement of the then Finance Secretary, and had come to the conclusion that no official of the Ministry of Finance, including the then Finance Minister, had committed any irregularity or misconduct.

“Therefore, any attempt by the opposition to foist any culpability on P Chidambaram is not only irresponsible but is yet another desperate attempt to make the institution of Parliamentary democracy dysfunctional,” Sibal added.

Sibal also made reference to quote given by Prime Minister which stated, “My own view has been that as far as the telecom policy that was sought to be implemented by the UPA government is concerned, in the basic policy, there was nothing wrong.”

He also said that the opposition in Parliament has an important role to play and the Government is willing to cooperate with the opposition to ensure that all issues of importance are discussed in accordance with the rules.

“The opposition must also cooperate with the Government in ensuring that government business is transacted and crucial legislations are passed,” he added.

After a heated debate, a meeting of the Faculty of Arts and Sciences Tuesday voted to remove two Summer School courses – Economics S-110 and Economics S-1316 – taught by Swamy, according to The Harvard Crimson, the campus newspaper.

Swamy received significant criticism for his op-ed last summer in Daily News and Analysis calling for the destruction of mosques, the disenfranchisement of non-Hindus in India who do not acknowledge Hindu ancestry, and a ban on conversion from Hinduism, it said.

“Swamy’s op-ed clearly crosses the line by demonising an entire religious community and calling for violence against their sacred places,” Comparative Religion Professor Diana L. Eck was quoted as saying.

Harvard has a moral responsibility not to affiliate itself with anyone who expresses hatred towards a minority group, she said. “There is a distinction between unpopular and unwelcome political views.”

Although Harvard chose to stand by Swamy in August in an effort to affirm its declared commitment to free speech, faculty members shot down his two courses, effectively removing him from Harvard’s teaching roster, the campus paper said.

Many faculty determined Swamy’s article was not a product of free speech-but of hate speech.

“[Swamy's position on disenfranchisement] is like saying Jewish Americans and African Americans should not be allowed to vote unless they acknowledge the supremacy of white Anglo Saxon Protestants,” said History professor Sugata Bose.

Dean of the Summer School Donald H. Pfister explained that courses included in the Harvard catalogue are chosen by individual departments.

The long-awaited Direct Tax Code (DTC) that seeks to simplify tax laws by lowering the tax rates and bringing more people and firms within the tax net is slated to come into force from the next financial year, beginning Apr 1, 2012, Finance Minister Pranab Mukherjee said here Wednesday.
“The proposed Direct Tax Code brings together the policy initiatives on the direct taxes and is slated to come into force from the next financial year,” Mukherjee said.

Addressing the 4th “International Tax Dialogue Global Conference”, Mukherjee said the proposed reforms were targeted at simplification of tax system and its administration, rationalisation of tax rates and broadening of its base.

He said taxation reforms was at the heart of India’s economic reforms and liberalisation that started in early 1990s.

“Tax reforms though gradual have been systemic in scope, particularly when we consider the proposals currently awaiting implementation. The reforms have covered both the direct taxes as well as the indirect taxes,” he said.

To reform the direct tax system, the government proposes to replace the archaic Income Tax Act, 1961, with a new legislation called Direct Tax Code.

In a bid to reform the indirect tax system, the government proposes to introduce Goods and Services Tax (GST) that will bring uniformity in tax structure across the country.

Commenting on the current progressive personal income tax system, Mukherjee said it was aimed to reduce inequalities in the society. He said the direct tax revenue has increased ten-fold in the last 14 years. Revenues from direct tax increased from $8.62 billion in 1996-97 to $87 billion in 2010-11.

“More importantly, the composition of our tax revenues has altered significantly in favour of direct taxes which now account for nearly 60 percent of our total tax revenues. We have tried to address the issue of gender inequality and old age vulnerabilities by providing some tax relief to women and old people,” he said.

Referring to the menace of tax evasion and black money, Mukherjee said tax evasion undermined the intended benefits of a progressive tax policy. He said the problem was compounded by illicit outflow of money from emerging economies and developing countries.

“Global financial integrity has estimated such annual illicit outflows averaging between $725-810 billion from these countries,” he said, adding the Indian government has adopted a five-pronged strategy to deal with these issues.

The strategy include joining the global crusade against black money, creating an appropriate legislation framework, setting up institution for dealing with illicit money, developing systems for implementations, and imparting skill to the manpower for effective action, the finance minister said.

Bhanwari Case: Former Minister Maderna ArrestedWorld News In a major breakthrough in the Bhanwari Devi missing case, the Central Bureau of Investigation (CBI) on Friday arrested former Rajasthan minister Mahipal Maderna, who is the main accused in the case. Co-accused Bishnoi was also arrested alongside Maderna. Bishnot is the brother of MLA Malkhan Singh, another suspect in the case.
Both Maderna and Bishnoi were arrested after being quizzed by the CBI in its Jodhpur office along with Bhanwari’s husband Amarchand. The investigating agency also recorded their statement in light of the new evidence, which it has collected.

Bhanwari case: Former minister Maderna arrested
Bhanwari, posted as auxiliary nurse and midwife at a sub-centre in Jaliwada village, around 120 kms from Jodhpur, went missing on September 1 and Maderna is accused of having a role in her disappearance.

Maderna and Bishnoi have been charged with abduction and intent to kill by the CBI. With these two arrest, the total number of arrested in the case has reached to five.

Maderna had earlier accepted before the CBI that he had a relationship with the missing nurse but denied any role in her going missing.

It should be noted that CBI has not yet declared Bhanwari Devi as dead because her body has not been found.

Meanwhile, the arrest of Maderna is being considered as huge embarrassment for the Ashok Gehlot government, which is already facing a lot of flak since the time, this case came into limelight.

Earlier in the day, the CBI filed chargesheet against four people in connection with the alleged kidnapping and murder of Rajasthan nurse Bhanwari Devi.

Bhanwari case: Former minister Maderna arrested
Those who have been booked are Sohanlal, Sahi Ram Bishnoi, Shahabuddin and Baldev for their role in the kidnapping of the nurse and her possible murder.

The chargesheet was filed hours after forensic experts of the probe agency found credible evidence from some lime-klins from Bilara and Pipara areas of the state.

The CBI claimed of founding important evidence – blood, hair, cloth and locket – from a Bolero belonging to Shahbuddin – having links with sacked Rajasthan minister Mahipal Maderana. Both are accused in the case.

The investigating agency also recorded the statement of labourers working at the lime-klins in connection with Bhanwari Devi’s alleged kidnapping and murder.

In view of the fresh evidence, the CBI is suspecting that the nurse was murdered and her body disposed off in the line klins.

Forensic experts are trying to match the samples collected from the area with those of Bhanwari’s relatives to verify and ascertain if she was killed and her body in the lime klins.

PM Says, Youth Congress Meet: FDI in Retail a Win-Win for India

PMWith the government under fire over the issues of foreign direct investment (FDI) in retail sector and the Jan Lokpal Bill, the Congress president and United Progressive Alliance (UPA) chairperson, Sonia Gandhi and Prime Minister Manmohan Singh on Tuesday sought to allay people’s fears at Youth Congress convention in New Delhi.

Speaking at the convention, Singh said the government’s decision to allow foreign equity in retail was not taken in haste but after a careful thought to how it would benefit the common man in India.

“We didn’t take the decision hastily. We have thought a lot and firmly believe that this decision will benefit us a lot,” said Singh, addressing a rally of elected Youth Congress leaders in New Delhi.

PM Says, Youth Congress Meet: FDI in Retail a Win-Win for India, Singh said he was confident that foreign direct investment in India’s retail sector would benefit farmers as “this will help to bring latest technology to the agriculture sector, less wastage and more jobs”.
The cabinet decision has triggered protests by opposition and key allies of the ruling United Progressive Alliance (UPA), who are demanding a rollback of the policy of approving 51 per cent FDI in multi-brand retail and 100 per cent in single brand retail.

This will allow foreign supermarkets to enter India and set up shop, they say.

The decision has led to a deadlock in Parliament with opponents claiming that it would adversely affect small traders and farmers and eat up jobs in the country.

But the prime minister sounded firm about the decision and has defied the calls to withdraw it.

“This will curb inflation and the common man can get daily essential commodities at lesser rates,” he said, reading from a paper in Hindi.

He asked young leaders of the ruling Congress to help the government in sending a right message to the public about its intention behind the FDI in India.

Singh flayed the Opposition for opposing the key decision on economic reforms, saying they were disrupting Parliament and blocking crucial legislations needed for India’s economic prosperity.

He said the world economic situation was affected by the US and European crisis but expressed hope that India’s inflation rate would fall sharply over the next few months.

“I am confident we will successfully face the global slowdown. I expect inflation will sharply decline in the next few months due to steps taken by the government,” he said.

Singh said the nation’s economic growth needed some new legislations and amendments to the older ones. “We need Parliament to work properly for this, but the opposition is not allowing it to happen,” he said.

“We always believe that the differences should be debated, and if we are disrupting Parliament we are doing injustice to the people who have elected us to parliament,” he said.

He said the government was trying to end the parliament logjam, triggered by various issues, including inflation, demand for statehood for Telangana, and now the FDI controversy.

He said the government has put certain conditions in the FDI decision so that small and medium enterprises were not affected by the proposed foreign equity.

“There will be no coercion. The states which think it is not fruitful can choose not to allow foreign shops in their states,” he said.

Sonia seeks Opposition support to run Parliament
With Parliament’s proceedings stalled since the start of the Winter Session a week ago, Congress president Sonia Gandhi on Tuesday sought support of the Opposition parties in passing some important legislations.

Addressing her first public rally post-surgery, Sonia said the government is working for an effective Lokpal bill to fight corruption.

“Together, with an effective Lokpal bill, the government is working on a variety of legislations which will systematically fight corruption. I hope the opposition will support us in passing these important measures,” she told the Indian Youth Congress (IYC) delegates at a convention in New Delhi.

Sonia said the political system needs administrative, judicial and electoral reforms including state funding of elections and fast tracking of corruption cases.

“In the last few months, there has been much talk about corruption. Corruption is indeed a plague of public life and we are committed to eradicate it. Our actions have shown this. The Right to Information (RTI), which our government brought in, places in hands of the people a powerful weapon against corruption,” she said.

Sonia appealed to the Youth Congress members to make sure that the schemes of the central government reaches all eligible people.

“Youth Congress members should provide feedback to the party and wherever these schemes are not reaching the common man, they should act as a pressure group for their proper implementation,” she said.

She said the government led by Prime Minister Manmohan Singh has taken number of measures that have brought great relief to the common man while ensuring them their rights.

“It is our government that brought in Mahatma Gandhi National Rural Employment Guarantee Scheme, Right to Information, Right to Education, and Forest Rights Act. The Right to Food bill is to be introduced in current session. The Aadhar scheme will give all people the right to identity,” she added.

The convention was attended by 7,000 delegates at the Japanese Park in Rohini in northwest Delhi. This is the largest convention of Youth Congress delegates since her son and party general secretary Rahul Gandhi took charge of the youth wing in 2007. Tuesday was the last day of the two-day event.

In fact, the convention is the brainchild of Rahul, the General Secretary in-charge of Youth Congress, who has been insisting that all office bearers should be called to the capital for a discussion with senior leaders and among themselves.

“Youth Congress office-bearers from all states would be represented at the conference. So they will get a chance to interact among themselves. He (Rahul) wanted such a convention,” he said.

This is the first time that such a convention of the Youth Congress will be held, the sources said, adding that the idea was mooted by Rahul.

Key NDA ally JD(U) has also given a notice of an adjournment motion in Lok Sabha on Monday and efforts are on for floor coordination among opposition parties including BJP, the Left, AIADMK, besides those supporting UPA such as BSP and SP.

The Left parties and AIADMK are likely to move similar motions in both the Houses.

Added to this is the fact that some constituents of the UPA like Trinamool Congress are also opposing FDI in retail.

Opposition sources said efforts were underway to bring on board DMK besides the Trinamool.

NDA Convener Sharad Yadav claimed that the entire opposition will remain united on this issue in Parliament.

“Parliament will not run at the cost of people. This decision of government will render crores of small business and vendors unemployed and destroy the unique village economy of the country,” he said.

The first week of the Winter Session which began on November 22 was a virtual washout in view of Opposition protest over various issues including price rise and Telengana.

On Friday, it was adjourned without transacting any business following uproar over the FDI issue.

“I lost my ustad – Ustad Sultan Khan, my guru my friend my idol. He passed away this afternoon. We will never have a sarangi maestro like him,” Salim tweeted.
